ARTICLE 1 – Acceptance of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale apply to all orders placed on the website mon-quad-electrique.com.

The customer acknowledges having read and accepted these General Terms and Conditions of Sale by clicking the checkbox “I have read and accept the General Terms and Conditions of Sale without reservation.” prior to confirming payment of their order.

ARTICLE 2 – Products & Services (The Offer)

The company offers products that are available in its warehouses.

It also provides customers with various products and services, including delivery and/or assembly. The company has made every effort to inform its customers by including a detailed description and helpful guidance on each product page.

Similarly, it provides as many photos as possible on each product page so that customers can view the item from multiple angles. These photos, although detailed, are for illustrative purposes only and are not contractually binding.

Whenever possible, a video has been created to demonstrate the product in standard use, allowing customers to better understand its operation and size.

Despite the company’s diligence, if an error is found in a product description, the company will make every effort to correct it as quickly as possible. However, the company cannot be held liable under any circumstances.

ARTICLE 3 – Order Validation

Orders placed on the website mon-quad-electrique.com constitute a firm and final commitment from the moment payment is made.

To place an order, the customer must first create a customer account.

Orders are confirmed by an automatic confirmation email sent by the website (within one hour of the order), summarizing the main details of the purchase. However, this email may be blocked by your spam folder or email filter.

If you have not received or located your order confirmation email, please contact the sales department (at 01 84 73 02 22 or via the “Contact” section of the website), and a copy will be sent to you.

The company reserves the right to cancel any order from a customer with whom there is an unresolved dispute regarding payment of a previous order.

The information provided by the customer at the time of ordering is binding. In particular, any error in the delivery address that prevents successful delivery shall not be attributed to the supplier. Additional costs incurred for re-delivery or address correction may be charged to the customer.

You are welcome to contact the sales department at any time with any questions regarding your order. The sales team is available through the following channels:

  • The online or offline chat service, where you can leave a message

  • By phone: 01 84 73 02 22 (standard rate), Monday to Friday from 9:00 a.m. to 12:30 p.m. and 2:00 p.m. to 5:30 p.m.

  • Via the “Contact” section of the website

ARTICLE 4 – Prices

All prices displayed on the website are shown in euros (€), inclusive of all taxes (TTC), including French VAT at 20%.

Prices listed on product pages do not include shipping fees.

To view standard delivery charges (for mainland France, excluding Corsica), simply add the desired product to your cart. The cart will then display the applicable shipping costs.

For delivery outside France or to Corsica, please provide your shipping address so we can calculate the appropriate fees.

For any specific delivery requests, feel free to contact our sales department

ARTICLE 5 – Payment Security

The website mon-quad-electrique.com offers several secure payment options:

  • Credit Card Payment: Fully secured via 3D Secure technology, which requires a verification code sent by your bank to your mobile phone to confirm the transaction. Your card details are entered directly on the bank’s secure platform and are never accessible to the company AUX LOISIRS ELECTRIQUES.

  • Bank Transfer: This method is handled outside the website. You will receive the company’s bank details (RIB) and can initiate the transfer through your bank. Be sure to include your order number (as issued by the website) in the transfer description.

  • Cheque Payment: If you choose to pay by cheque, your order will be shipped at least 15 business days (Monday to Saturday) after the cheque has been cleared. This delay is necessary due to past issues with unpaid cheques.

All payment methods are designed to ensure maximum security and transparency. For any specific questions or assistance, customers are encouraged to contact the sales department.

ARTICLE 6 – Delivery

As a general rule, orders placed before 11:00 a.m. (Monday to Friday) are shipped the same day. Orders placed after this time are shipped on the next business day (Monday to Friday).

Deliveries are handled by two main carriers:

  • DPD France: Responsible for spare parts and smaller parcels (up to approx. 30 kg). DPD delivers Monday to Friday, without appointment, within 24 to 72 hours (typically within 24 hours).

  • DB Schenker: Handles larger parcels (over 30 kg). Delivery takes 3 to 5 days, and DB Schenker contacts the customer in advance to schedule a delivery date (Monday to Friday).

Occasionally, other carriers may be used (GLS, Chronopost, La Poste, etc.) solely to optimize delivery.

Upon delivery, it is essential to ALWAYS CHECK the condition of your order BEFORE signing the delivery slip.

Customers must open the package and inspect the contents. If any damage or irregularity is observed, they should note specific reservations on the delivery slip—or refuse the package if the product appears severely damaged.

Whether the package is accepted or refused, the customer must confirm these reservations by registered mail with acknowledgment of receipt to the carrier within 48 business hours (Monday to Saturday) following delivery.

For assistance, customers are encouraged to contact the sales department of mon-quad-electrique.com.

ARTICLE 7 – Product Returns

If you wish to return a product because it does not meet your expectations or you have simply changed your mind, you must first contact the sales department of mon-quad-electrique.com.

Return shipping is at your own expense and risk. We will refund the product upon receipt, provided that it is returned in the same condition as delivered (new and unassembled for items that require assembly).

⚠️ Please note that we do not accept returns for certain products, especially controllers and control units, as we are unable to verify whether they have been installed or damaged by the customer. To avoid restocking potentially faulty items, we choose to refuse returns for this type of product.

If the product is returned damaged, we will issue a damage report so that you may file a claim with the carrier’s insurance. In this case, we will not be responsible for refunding the product.

ARTICLE 8 – Right of Withdrawal

You have 14 calendar days from the date of receipt of your order to submit a withdrawal request using the appropriate form.

For rideable vehicles, any assembly or use (even a brief test) voids the product’s “new and unused” status. The right of withdrawal no longer applies if this condition is not met.

Certain electronic components (such as controllers and throttle grips) are excluded from the right of withdrawal, as it is impossible to verify whether they have been used or damaged in a way that is not immediately visible.

Inner tubes are also excluded, as they may have been punctured in a way that renders them unusable.

The spirit of the right of withdrawal requires certainty that the returned item can be resold as-is to another customer without any need for repair or refurbishment.

Once your withdrawal request has been acknowledged, items must be returned to the address provided by the company, at your expense, in their original and complete packaging (including all accessories, manuals, etc.). The product must not have been used or assembled and must arrive in original condition.

In accordance with Article L.121-21-3 of the French Consumer Code, you are responsible for the direct costs of returning the goods.

For heavy or bulky items shipped via freight, return costs may be approximately double the original shipping fees, depending on the carrier.

Items delivered on pallets must be returned secured and protected on a pallet to ensure safe transport.

It is strongly recommended to take out ad valorem insurance with your chosen carrier. Otherwise, legal compensation is capped at €23 per kilogram, not exceeding the original value of the goods.

Smaller items may be returned via postal services (e.g. Colissimo, Chronopost) with proof of delivery, provided they meet postal size and weight limits.

If the right of withdrawal is exercised, AUX LOISIRS ELECTRIQUES SAS is required to refund all amounts paid (including outbound shipping fees) within 30 days of the withdrawal date, provided the product has been received and inspected.

ARTICLE 9 – Warranty

All products sold by mon-quad-electrique.com benefit from the 2-year legal warranty against manufacturing defects, in accordance with French consumer law.

However, this legal warranty does not cover normal wear and tear of the vehicle. To complement this, mon-quad-electrique.com offers a commercial warranty of:

  • 6 months for parts

  • 3 months for batteries

This commercial warranty does not replace your 14-day right of withdrawal upon receipt of your order. For more details, please refer to Article 8 of these Terms and Conditions.

⚙️ Legal Warranty

The legal warranty covers manufacturing defects only. To qualify, the defect must have existed prior to delivery. A defect present at the time of delivery will typically be noticeable within the first few uses of the product.

Normal wear, misuse, or improper handling are excluded from this warranty.

ARTICLE 14 – Force Majeure

The performance of obligations by AUX LOISIRS ELECTRIQUES SAS under these Terms and Conditions shall be suspended in the event of a fortuitous event or force majeure that prevents their execution.

In such cases, the Seller will inform the Customer of the occurrence of the event as soon as possible.

ARTICLE 15 – Nullity and Amendment of the Contract

If any provision of this contract is declared null and void, such nullity shall not affect the validity of the other provisions, which shall remain in force between the parties.

Any amendment to the contract shall be valid only upon written agreement.

ARTICLE 16 – Personal Data Protection

In accordance with the French Data Protection Act of January 6, 1978 (Article 34), the Customer has the right to query, access, modify, object to, and rectify personal data concerning them.
